Whenever a person dies, his or her estate needs to be collected and managed. Estate Administration involves gathering the assets of the estate, paying the deceased’s debts and distributing the remaining assets.

Probate (Where the deceased has a Will)

Probate is the legal process whereby a will is "proved" in the High Court and accepted as a valid public document that is the true last testament of the deceased. It is a Court order that confirms that the executor(s) have the legal authority to deal with the deceased's estate.

 

Letters of Administration (Where the deceased does not have a Will)

Where the deceased did not leave a Will the Will is invalid or where the executors appointed under the Will have either predeceased the deceased, or are unable or unwilling to act, an application to the High Court for a Grant of Letters of Administration is required.

In certain circumstances a Grant of Probate or Letters of Administration may not be required, for example if the estate is small or if the property is jointly owned.
